Welcome to getmemoryframe.com. This website is operated by MemoryFrame™. Throughout these Terms of Service, “MemoryFrame,” “we,” “us,” and “our” refer to MemoryFrame™.

By visiting our website, submitting a photograph, placing an order, or using any part of our services, you agree to these Terms of Service. If you do not agree, please do not use the website or place an order.

1. Eligibility and Website Use

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order.

You agree to provide current, complete, and accurate account, payment, billing, shipping, personalization, and contact information.

You may not use our website or products for an unlawful, fraudulent, abusive, or unauthorized purpose.

2. Personalized Products

MemoryFrame™ creates personalized products from customer-supplied photographs, names, dates, messages, and other information.

Because our products are individually 3D-printed and made to order, minor variations in texture, shading, color, surface appearance, and positioning may occur. These variations are a natural part of the production process and are not necessarily defects.

Lithophane images are designed to reveal greater detail when illuminated. The appearance of a product when unlit may differ from its appearance when lit. Screen displays, photography, lighting, and monitor settings may also affect how product images appear online.

Product measurements, materials, included components, and other specifications are described on the applicable product page.

3. Customer Photographs and Personalization

You are responsible for confirming that the photograph, spelling, names, dates, and personalized message submitted with your order are correct.

By submitting a photograph or other content, you confirm that you own it or have permission to use it and authorize MemoryFrame™ to reproduce, crop, adjust, process, and use it as necessary to create and fulfill your order and provide customer support.

This limited permission does not give MemoryFrame™ the right to use your personal photograph in advertising, social media, or other promotional materials without separate permission from you.

We reserve the right to reject photographs or content that are unlawful, infringing, threatening, hateful, pornographic, abusive, or otherwise inappropriate.

We review submitted photographs before production. If we believe a photograph will not produce a satisfactory result, we may contact you for another photograph. Production may be delayed while we wait for your response.

4. Orders and Order Acceptance

Submitting an order does not guarantee acceptance. We may refuse, limit, or cancel an order because of payment problems, suspected fraud, product availability, pricing errors, inappropriate submitted content, technical problems, or other reasonable business concerns.

If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method.

You will receive an order confirmation at the email address entered during checkout. Please review it promptly and contact us immediately if anything is incorrect.

5. Prices, Payments and Taxes

Prices are displayed in the currency indicated on the website or during checkout. Prices, products, promotions, and availability may change without notice.

Payment must be successfully authorized before an order can be processed.

Applicable sales tax, shipping charges, duties, import taxes, and other charges will be displayed during checkout when available. International customs charges might instead be collected by the carrier or destination country.

We reserve the right to correct pricing or product-description errors. If an error affects an order, we may contact you for approval of the corrected amount or cancel and refund the order.

6. Changes, Cancellations, Returns and Refunds

Contact us as soon as possible if you need to change or cancel an order.

Because personalized products are made to order, we cannot guarantee that an order can be changed or canceled after production has started. Our complete cancellation, return, replacement, and refund terms are contained in our Refund Policy, which is incorporated into these Terms.

If information supplied by the customer is incorrect, including a misspelled name, incorrect date, wrong message, or wrong photograph, contact us and we will try to help. We cannot guarantee a free remake when the completed product matches the information submitted with the order.

If the mistake was made by MemoryFrame™, we will correct it in accordance with our Refund Policy.

7. Shipping and Delivery

Processing and delivery estimates are provided in our Shipping Policy. Delivery dates are estimates and are not guaranteed.

Customers are responsible for entering a complete and accurate delivery address. Address changes cannot be guaranteed after production or fulfillment begins.

MemoryFrame™ is not responsible for delays caused by carriers, severe weather, customs processing, incorrect addresses, holidays, labor disruptions, or other circumstances outside our reasonable control. We will, however, make reasonable efforts to assist with shipping problems.

8. Digital Gift Cards

MemoryFrame™ gift cards are digital products delivered electronically. No physical gift card is mailed unless expressly stated.

Gift cards may be redeemed only at getmemoryframe.com. They cannot be exchanged for cash except where required by law. Gift cards are non-refundable except where otherwise required by law.

Customers are responsible for supplying the correct recipient email address and protecting the gift-card code. Contact us promptly if a gift-card email is not received or if you believe a code has been compromised.

Gift-card expiration and redemption terms are governed by the information provided at purchase and applicable law.

9. Promotions and Discount Codes

Promotions and discount codes may have separate eligibility requirements, expiration dates, exclusions, or purchase limits.

Discount codes cannot be combined unless expressly permitted. Promotions have no cash value and cannot be applied retroactively to previous purchases.

Our Refund Policy applies unless a promotion clearly states different terms that are permitted by applicable law.

10. Intellectual Property

The MemoryFrame™ name, logo, website design, product photographs, graphics, written content, videos, and other original materials are owned by or licensed to MemoryFrame™ and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, sell, or commercially exploit our content without written permission.

Products are sold for personal use or gifting. Resale on Amazon, eBay, or another marketplace is prohibited without written authorization from MemoryFrame™.

11. Reviews and Feedback

If you submit a product review, comment, suggestion, photograph of your completed product, or other feedback, you grant us permission to display and reproduce that submission in connection with our website and business.

We will not use the original personal photograph uploaded solely for production in advertising without separate permission.

Reviews must reflect genuine experiences and may not contain unlawful, abusive, misleading, infringing, or private information. We may moderate content when reasonably necessary, but we do not promise to publish every submission.

12. Third-Party Services and Links

Our store is hosted by Shopify, and we may use third-party providers for payments, personalization uploads, reviews, shipping, analytics, marketing, and other store functions.

Third-party services and websites may have their own terms and privacy practices. MemoryFrame™ is not responsible for the content, availability, or practices of websites or services that we do not control.

13. Prohibited Conduct

You may not:

• Violate applicable laws or the rights of another person.

• Submit content that you do not have permission to use.

• Introduce malware, viruses, or harmful code.

• Attempt to interfere with the security or operation of the website.

• Use automated tools to scrape, copy, or misuse website content.

• Submit false information or engage in fraudulent transactions.

• Harass, threaten, impersonate, or harm another person.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

14. Website Accuracy and Availability

We try to keep product descriptions, photographs, prices, availability, and other website information accurate. However, occasional errors, omissions, or outdated information may occur.

We may correct errors, update information, cancel affected orders, or modify or discontinue products or website features without prior notice.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, MemoryFrame™ will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from use of the website, delivery delays, third-party services, or use of our products.

For a claim relating to a purchased product, our total liability will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

17. Indemnification

You agree to indemnify and hold MemoryFrame™ and its service providers harmless from claims, damages, or reasonable expenses arising from your unlawful use of the website, your violation of these Terms, or content you submit without the necessary ownership or permission.

18. Severability and Waiver

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

19. Governing Law

These Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles.

Nothing in this section removes rights or protections that cannot be waived under the laws applicable to a customer.

20. Changes to These Terms

We may update these Terms periodically. The updated version will be posted on this page with a revised “Last updated” date.

Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
